The domain name GUMENCATERING through which this Portal is accessed is the property of GUMEN CATERING, S.L. Its use in connection with content, products or services that are not the property of GUMEN CATERING, S.L., or that may cause confusion among end users or discredit GUMEN CATERING, S.L., is prohibited.
Purpose
The purpose of this Legal Notice is to establish the General Conditions governing access to, browsing of and use of the aforementioned Portal by all Users. If the User does not agree with them, they shall not be entitled to use the website of GUMEN CATERING, S.L.
Accessing this Portal implies the User's full knowledge and acceptance of the terms and conditions of use of the Portal, in the version published at the time the website is accessed.
In this regard, GUMEN CATERING, S.L. reserves the right to modify or update, at any time, these General Conditions and, in general, the elements that make up the design and configuration of the Portal. For this reason, GUMEN CATERING, S.L. recommends that Users read these conditions carefully each time they access the Portal.
The Owner reserves the right to terminate, suspend or interrupt, at any time, access to the products, services and/or Contents of the Portal, as well as the configuration of the Portal itself, its features, products, services and Contents, without the User being able to claim or demand any compensation: in particular, due to maintenance, repair, updating or improvement operations and/or adaptation to technical, operational and/or legal changes. After such termination, the prohibitions, restrictions and limitations contained in this Legal Notice and/or in any applicable particular conditions shall remain in force.
Access to and use of the portal
The User declares that they have the legal capacity necessary to be bound by this agreement and to use this Portal in accordance with the General Conditions set out herein, which they fully understand.
Mere access to the Portal, use of the content offered on it, as well as the completion of forms, the sending of requests for information and, in general, any act of a similar nature to the above shall imply, on the part of those browsing the Portal, the acquisition of the status of User and the acceptance, without reservation, of each and every one of the rules that make up this Legal Notice.
The User also declares that all information provided by them in the course of using this Portal is true, complete and accurate.
In any event, access to, browsing of and use of the Portal is carried out under the sole and exclusive responsibility of the User, who undertakes to diligently and faithfully observe any additional instructions regarding the use of the Portal and its contents. In this regard, the User undertakes to use the contents of the Portal in a diligent, correct and lawful manner, in accordance with current legislation and, in particular, undertakes to refrain from:

Intellectual and industrial property
All the contents of the Portal — understood, by way of illustration and not limitation, as the texts, photographs, graphics, images, icons, technology, navigation structure, software, audiovisual or sound content, graphic design and source code, indexes, trademarks, logos, expressions and information and, in general, any other creation protected by national regulations and international treaties on intellectual and industrial property (hereinafter, the contents) — are the intellectual property of GUMEN CATERING, S.L. or of third parties from whom GUMEN CATERING, S.L. has obtained the corresponding licence.
All intellectual and industrial property rights over the Contents are reserved, and any unauthorised use or exploitation of the contents shall give rise to liability.
The use of trademarks, trade names or distinctive signs owned by the Owner or by third parties is also prohibited without the prior written consent of their Owner.
Responsibilities of the Owner
The Owner declares that it has adopted all necessary and reasonable measures, within its possibilities and the state of technology, to guarantee the operation of the Portal and to prevent the existence and/or transmission of viruses and other harmful components to Users.
Likewise, the Owner shall use all reasonable means at its disposal to verify the truthfulness, accuracy, adequacy, suitability, completeness and currency of the information and contents provided on the Portal.
Exclusion of warranties
The User expressly acknowledges and accepts that the Owner does not grant any warranty of any kind, whether express or implied, regarding the reliability, usefulness or accuracy of the information published and/or provided on the Portal in relation to the products and/or services of GUMEN CATERING, S.L.
In particular, the Owner does not guarantee and is not responsible for:
- The lack of availability or accessibility of the Portal or the continuity of the Portal's contents;
- The existence of interruptions, errors in access to the Portal or malfunctioning of the Portal, as well as technical problems or failures occurring during the Internet connection;
- The absence of viruses and other harmful computer elements on the Portal or the server supplying it; it is the User's responsibility, where applicable, to have adequate means for detecting or disinfecting harmful computer programs.
- The invulnerability of the Portal and of the security measures adopted on it;
- The absence of errors in the contents;
- The suitability for a particular purpose of the Portal and of the information published and/or provided in relation to the products or services of GUMEN CATERING, S.L.;
- Decisions taken on the basis of the information provided on the Portal, or damages suffered by the User or third parties as a result of actions based solely on the information obtained on the Portal;
- Damage caused to the computer equipment of users or third parties during the provision of the Portal service;
- Any other damage that may be caused by the defective operation of the Portal.
Links pointing to this portal
In the event that any User, entity or website wishes to establish any type of link pointing to the Portal, prior to creating such a link they must obtain express written authorisation from the Owner, and the link must be absolute and complete, in the sense that it points to the main page of GUMEN CATERING, S.L., covering the entire extent of the Portal's main page.
If the entity creating the link from its website to the Portal of GUMEN CATERING, S.L. also wishes to include on its website the trademark, name, trade name, sign, logo or any other identifying sign of the Owner and/or the Portal, it shall require the prior express written authorisation of GUMEN CATERING, S.L.
Severability
In the event that any provision of this Legal Notice is deemed null and void, in whole or in part, such nullity or inapplicability shall not affect the other provisions of the Legal Notice or any particular conditions that may have been established.
If the Owner does not exercise any right or action recognised in this Legal Notice, this shall not constitute a waiver thereof, except by express written acknowledgement and agreement on its part.
Applicable law and competent courts
This Legal Notice shall be governed by Spanish law. For the resolution of any dispute, the parties shall submit to the Courts and Tribunals with jurisdiction under the law. Where the user is a consumer, the competent court shall be that of the consumer's domicile, a mandatory jurisdiction that cannot be waived.
